Terms and conditions of participation from 8 June 2026

1. Validity

In order to provide the services offered by Burning Heart, hereinafter referred to as the "organizer", we must state certain provisions to comply with legal requirements.

These provisions and all legal relationships between you and Burning Heart are subject exclusively to German law. Should individual provisions be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the meaning of the invalid provision, if possible.

Burning Heart reserves the right to change these provisions at any time. No explicit notice of changes will be given.

2. Subject of the contract

The organizer offers workshops, seminars, and trainings. The fundamental subject of the contract is the binding registration and booking of events, regulations regarding cancellation and withdrawal, as well as the general terms of participation.

3. Registration / conclusion of contract

A contract with the organizer is concluded through the submission and confirmation of the completed declaration of participation (registration form) via electronic registration over the internet or an informal email to enjoy@burningheart.net.

Registration via social media (Joyclub, Facebook, etc.) is invalid.

Each participant receives a registration confirmation after their declaration of participation/registration is received. If your chosen event is already fully booked, we will notify you, place your registration on a waiting list, and inform you when a place becomes available.

4. Cancellation / withdrawal from a booking

You may withdraw from your registration in writing up to four weeks before the start of an individual seminar (the date of receipt by the organizer applies). A processing fee of 10% of the seminar costs will then apply. In the case of later cancellation of the contract, the full seminar fee is due unless you name a suitable substitute participant. For ongoing events (e.g. closed groups), these participation and withdrawal conditions apply with the date of the first event.

For individual evening events, cancellation is possible up to 48 hours before the start; reimbursement is provided in the form of a credit.

Should we have to cancel an event for important or higher reasons (for example due to illness of the course instructor, insufficient number of participants, or externally imposed measures), the participant is entitled to a full refund of seminar fees already paid; no further claims exist for participants in this regard.

4a. Special provisions for the Burning Heart Festival

• Cancellation policy
  We understand that plans can change. At the same time, organizing a festival requires reliable planning. The following regulations therefore apply to festival bookings:
  • Cancellation by participants
    • Up to 60 days before the festival begins: refund of the ticket price minus a processing fee of €50.
    • Up to 30 days before the festival begins: refund of 50% of the ticket price.
    • From 29 days before the festival begins, refunds are excluded.
    
    The date of receipt of the written cancellation by the organizer is decisive for calculating the deadline.
  • Ticket transfer
    Transferring a ticket to another person is possible free of charge at any time. The transfer becomes effective once the complete contact details of the substitute person have been communicated in writing.
  • Goodwill policy
    In special cases, particularly in the event of illness, accident, or comparable serious events, the organizer may grant a credit for a future event after individual review. There is no legal entitlement to this.
  • Cancellation by the organizer
    Should the festival be cancelled by the organizer, ticket payments already made will be refunded in full.
    Further claims, in particular for travel, accommodation, catering, or other consequential costs, are excluded to the extent permitted by law.
  • Recommendation
    We recommend taking out seminar, event, or trip cancellation insurance.
• Consent and boundaries
  By registering for and participating in the festival, participants agree to the applicable guide for a safe, conscious, and respectful space. The guide forms part of the festival agreement and will be made available to participants before the event begins.
  Participants undertake to respect and comply with the rules described therein. The organizer reserves the right to exclude persons who repeatedly or seriously violate these rules from further participation. In this case, the ticket price will not be refunded.
• Photo and video recordings
  Photo and video recordings may be made during the event. These recordings may be used for the organizer's public relations work, in particular on the website, on social media, and in print and promotional materials for future events.
  The organizer undertakes to handle image material respectfully and with care.
  Participants who do not wish to be photographed or filmed are asked to inform the organizer before or during the event. The organizer will take this into account within the scope of organizational possibilities.

5. General terms of participation

Participation in the seminar offering is voluntary. You bear full responsibility for yourself and your actions inside and outside the course. For any damage caused, you are liable yourself and indemnify the organizer, course instructors, and hosts at the event venues from all liability claims.

The organizer is liable only in cases of intent or gross negligence in accordance with statutory provisions.

The seminar leader/coach/trainer has authority to give instructions to participants for the duration and within the scope of the event.

In cases of recognizable health or psychological problems where danger to oneself or others cannot be ruled out, the seminar leader reserves the right at any time not to continue cooperation and, if necessary, to exclude participating persons from the seminar. Course costs will be refunded proportionally in this case. Further claims are excluded.

A participant acts in breach of contract if, despite a warning, they persistently disrupt the event, or if they behave in a manner that significantly violates good morals such that the smooth running of the event can no longer be guaranteed. If exclusion from the group is pronounced for these reasons, no refund of course and full-board costs will be made.

If a participant ends the seminar early of their own accord, no reimbursement will be made.

We would also like to point out that our seminars and trainings are not a substitute for medical or psychiatric treatment. If you are not fully physically or mentally fit, are in a compromised state of health, or are undergoing medication treatment, please inform us before the course begins. If you are currently in psychotherapeutic or psychiatric treatment, you should clarify in good time with your therapist or doctor and with us whether participation in the seminar seems advisable.

Contagious infectious diseases exclude participation in the seminars.

6. Seminar insurance

It is possible to protect yourself against cancellation for important reasons (e.g. illness or accident) with trip cancellation insurance.
